An <strong>affected person<\/strong> is a person whose personal data we process.<br \/>\n<strong>Processing<\/strong> encompasses <em>every<\/em> handling of personal data, <em>regardless<\/em> of the methods and procedures used, for instance, accessing, matching, adjusting, archiving, retaining, reading, disclosing, obtaining, capturing, collecting, deleting, revealing, arranging, organizing, storing, modifying, distributing, linking, destroying, and using personal data.<\/p>\n<p>The <strong>European Economic Area (EEA)<\/strong> includes the <a href=\"https:\/\/en.wikipedia.org\/wiki\/Member_states_of_the_European_Union\" target=\"_blank\" rel=\"nofollow noopener\">Member States of the European Union<\/a> (EU) as well as the Principality of Liechtenstein, Iceland, and Norway. The General Data Protection Regulation (GDPR) refers to the processing of personal data as the processing of personal-related data.<\/p>\n<h3 id=\"legal-bases\">2.2 Legal Bases<\/h3>\n<p>We process personal data in accordance with Swiss data protection law, in particular the <a id=\"111802\" href=\"https:\/\/www.fedlex.admin.ch\/eli\/oc\/2022\/491\/en\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">Federal Act on Data Protection<\/a> (Data Protection Act, DPA) and the <a href=\"https:\/\/www.fedlex.admin.ch\/eli\/oc\/2022\/568\/en\" target=\"_blank\" rel=\"nofollow noopener\">Ordinance on Data Protection<\/a> (Data Protection Ordinance, DPO).<\/p>\n<p><span id=\"legal-bases-gdpr\">We process personal data in accordance with the General Data Protection Regulation (GDPR) \u2013 where and to the extent that it applies \u2013 based on <em>at least<\/em> one of the following legal bases:<\/span><\/p>\n<ul>\n<li><a href=\"https:\/\/steigerlegal.ch\/gdpr\/gdpr-6\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">Art. 6 Para. 1 lit. b GDPR<\/a> for the necessary processing of personal data for the performance of a contract with the data subject and for taking steps prior to entering a contract.<\/li>\n<li>Art. 6 Para. 1 lit. f GDPR for the necessary processing of personal data to pursue our or a third party&#8217;s legitimate interests, unless the fundamental freedoms, rights, and interests of the data subject prevail. Legitimate interests particularly include our aim to permanently conduct our activities in a user-friendly, safe, and reliable manner, ensuring information security, protection against misuse, enforcing our legal claims, and complying with Swiss law.<\/li>\n<li>Art. 6 Para. 1 lit. c GDPR for the necessary processing of personal data to comply with a legal obligation under any potentially applicable law of member states within the European Economic Area (EEA).<\/li>\n<li>Art. 6 Para. 1 lit. e GDPR for the necessary processing of personal data to perform a task carried out in the public interest.<\/li>\n<li>Art. 6 Para. 1 lit. a GDPR for the processing of personal data with the consent of the data subject.<\/li>\n<li>Art. 6 Para. 1 lit. d GDPR for the necessary processing of personal data to protect vital interests of the data subject or another natural person.<\/li>\n<\/ul>\n<h2 id=\"type-scope-purpose\">3. Type, Scope, and Purpose<\/h2>\n<p>We process the personal data that is <em>necessary<\/em> to continuously, user-friendly, securely, and reliably conduct our activities. Such personal data can particularly fall into the categories of basic and contact data, browser and device data, content data, meta or margin data, usage data, location data, sales data, as well as contract and payment data.<br \/>\nWe process personal data for the <em>duration<\/em> that is necessary for the respective purpose or purposes or as required by law. Personal data no longer needed for processing is anonymized or deleted.<\/p>\n<p>We may have personal data processed <em>by third parties<\/em>. We can process personal data in collaboration with third parties or transfer it to third parties. Such third parties particularly include specialized providers whose services we use. We also ensure data protection with such third parties.<\/p>\n<p>We process personal data <em>fundamentally<\/em> only with the consent of the affected individuals. Where and to the extent that processing is allowed based on other legal reasons, we might not seek consent. Personal Data Abroad<\/h2>\n<p>We process personal data <em>principally<\/em> in Switzerland and in the European Economic Area (EEA). However, we may also export or transfer personal data to other countries, especially for processing or to be processed there.<br \/>\nWe can export personal data to all <a href=\"https:\/\/en.wikipedia.org\/wiki\/List_of_countries_by_population_(United_Nations)\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">countries and territories on Earth<\/a> and elsewhere in the <a href=\"https:\/\/www.datenschutzpartner.ch\/2022\/04\/23\/data-protection-declaration-data-export-universe-moon\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">Universe<\/a>, provided that the local law, according to the <a href=\"https:\/\/steigerlegal.ch\/2022\/09\/10\/ndsg-switzerland-list-of-countries\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">decision of the Swiss Federal Council<\/a>, ensures adequate data protection and &#8211; if and to the extent that the General Data Protection Regulation (GDPR) applies &#8211; according to the <a href=\"https:\/\/commission.europa.eu\/law\/law-topic\/data-protection\/international-dimension-data-protection\/adequacy-decisions_en\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">decision of the European Commission<\/a>, ensures adequate data protection.<\/p>\n<p>We can transfer personal data to countries whose law does not ensure adequate data protection, provided data protection is ensured for other reasons, especially based on standard data protection clauses or other appropriate guarantees. In exceptional cases, we may export personal data to countries without adequate or suitable data protection if the specific data protection requirements are met, for example, the explicit consent of the affected persons or a direct connection with the conclusion or execution of a contract. We will gladly provide affected persons with information about any guarantees upon request or provide a copy of any guarantees.<\/p>\n<h2 id=\"rights\">5. Rights of Affected Persons<\/h2>\n<h3 id=\"claims\">5.1 Data Protection Claims<\/h3>\n<p>We grant affected persons all claims according to applicable data protection law. Affected individuals are required to cooperate.<\/p>\n<h3 id=\"right-to-complain\">5.2 Right to Complain<\/h3>\n<p>Affected individuals have the right to enforce their data protection claims through legal channels or to lodge a complaint with a competent data protection supervisory authority.<br \/>\nThe data protection supervisory authority for private entities and federal bodies in Switzerland is the <a href=\"https:\/\/www.edoeb.admin.ch\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">Federal Data Protection and Information Commissioner<\/a> (FDPIC).<\/p>\n<p>If and when the General Data Protection Regulation (GDPR) is applicable, affected individuals have the right to lodge a complaint with a competent <a href=\"https:\/\/edpb.europa.eu\/about-edpb\/about-edpb\/members_en\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">European data protection supervisory authority<\/a>.<\/p>\n<h2 id=\"security\">6. Data Security<\/h2>\n<p>We take appropriate technical and organizational measures to ensure data security commensurate with the respective risk. The Meta Platforms Ireland Limited is part of the <a href=\"https:\/\/www.facebook.com\/help\/111814505650678\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">Meta companies<\/a> (including those in the USA). Page Insights provide insights into how visitors interact with our Facebook presence.
